Buying Property

EU and EEA citizens can buy apartments and land under the exact same conditions as Bulgarian citizens. Non-EU citizens can freely purchase apartments and commercial properties in their own name, but cannot personally acquire agricultural and forestry land, except through inheritance by law or international treaties.

Property viewing and legal due diligence, preliminary contract with a deposit (kaparo), obtaining tax valuation, cadastre sketch from GCCA, certificate of encumbrances, and title deed. The transaction is finalized before a notary and registered with the Registry Agency, usually within 3 business days.

Certificate of encumbrances, verification that the seller is the registered owner, cadastre sketch, and tax valuation. If there are co-owners, all must sign. For new developments, check the construction stage (Act 14, 15, 16) and use permit.

Under Art. 93 of the CPA, if the buyer withdraws without legal grounds, the seller retains the deposit; if the seller withdraws, they must return double the deposit amount. Never pay a deposit before completing legal verification.

The three main expenses are notary fees (+ 20% VAT), local acquisition tax (set by municipalities between 0.1% and 3%, typically 3% in Sofia, Varna, Plovdiv, and Burgas), and a 0.1% registration fee. Tax is calculated on the higher of the sale price or tax valuation. For an €80,000 property in Sofia, total notary and transfer fees are approximately €2,800–€3,000.

Under Art. 186 of the CPA, transfer costs are borne by the buyer unless agreed otherwise. Local property acquisition tax is legally paid by the purchaser.

Selling Property

No. Under Art. 13 of the Personal Income Tax Act, capital gains are tax-exempt for: one residential property owned for more than 3 years; up to two properties of any kind owned for more than 5 years; or property acquired by inheritance.

When selling before 3/5 years of ownership, selling a second residential property in the same calendar year, selling more than two properties in a year, or selling a gifted property (acquisition price is €0 for donations).

(Sale price − Acquisition price − 10% statutory deemed expenses) × 10%. Example: bought for €80,000 and sold after 2 years for €110,000 → taxable base is €27,000, tax due is €2,700.

Only if the capital gains are taxable. Submit the Annual Tax Declaration (Appendix 5) between January 10 and April 30 of the following year. A 5% discount applies for electronic filing and payment by March 31.

Yes. The tax authority (NRA) can adjust the transaction to market value and impose back taxes, interest, and fines. In case of contract invalidation, the buyer can only legally reclaim the exact amount stated in the deed.

Not on occasional private sales. For corporate developers, selling new buildings (under 5 years from Act 16) is subject to 20% VAT.

Renting Property

While oral agreements are legally valid, a written contract is essential to protect both parties. It must specify the parties, address, rental price in euros, deposit amount, payment method, lease term, and termination terms. Maximum lease duration by law is 10 years.

Typically 1 to 2 months' rent, paid against a handover protocol and receipt upon signing. It is refunded within 7–30 days after vacating, provided there is no damage beyond normal wear and tear and all utility bills are settled.

The tenant pays consumption utilities (electricity, water, heating, internet) and monthly building management fees. The landlord is responsible for annual property tax, waste tax, and major building structural repairs.

No. Self-help eviction or locking out tenants is unlawful. Landlords must follow formal written notice procedures and court execution if necessary.

For leases longer than 1 year, notarization and registration with the Registry Agency ensure the tenancy remains binding even if the property is sold to a new owner (0.1% registration fee).

Individual landlords deduct 10% statutory recognized expenses and pay a 10% income tax on the remainder (an effective tax rate of 9%). Advance tax is declared quarterly, with final settlement by April 30.

By mutual agreement, written notice (typically 1–3 months), upon expiry of the agreed term, or unilaterally in the event of severe breach of contract.

An official extract from the Registry Agency verifying mortgages, foreclosures, court claims, or registered long-term leases on the property. It should be checked before the preliminary contract and on the day of the notary transfer.

Tax valuation is an administrative value determined by the municipality. Notary fees and local transfer taxes are calculated based on whichever is higher between the agreed market price and the tax valuation.

Precise property description (cadastre identifier, boundaries, area), price in euros, deposit amount, notary completion deadline, fee distribution, and penalties for non-performance.
